CALL TO ORDER

Mayor Knight called to order the regular meeting of the Rutledge City Council on the above date. Council members Brenda Thompson, Tony Sells, Tim Smith and Bruce Altznauer were present. No citizens were present.

PLEDGE OF ALLEGIANCE

Mayor Knight called for and led the Pledge of Allegiance.

AGENDA AMENDMENT

Council member Tony Sells made motion to amend the agenda to add item number 6-A Undo Moratorium on Apartments. Tim Smith seconded, all voted in favor and motion carried.

 

APPROVAL OF MINUTES

 

Bruce Altznauer made motion to approve the July 18, 2017 regular meeting minutes as submitted. Tim Smith seconded, all voted in favor and motion carried. Brenda Thompson made motion to approve the July 31, 2017 public hearing minutes as submitted. Tim Smith seconded, all voted in favor and motion carried.

DISCUSSION OF TEXT AMENDMENTS RUTLEDGE ZONING ORDINANCE

Mayor Knight stated that the text amendments relate to accessory dwellings, multi-family dwellings and additional buildings other than the primary resident. Tara Cooner said currently the ordinance does not allow any multifamily housing in the City. Currently it allows loft or efficiency apartments in CH but requires it to be one large space. The concern with this was the removal of retail use. She said also the inclusion of both accessory dwelling and accessory apartments is confusing despite the regulation that it would be occupied by family. There is no way to enforce such a regulation. Currently, duplexes and multifamily are permitted in R-4. This would be a conditional use in the downtown (CH). They will have to prove to use without destroying the downtown and they will also need to address parking somewhere besides in front of the retail business. Now they can use the entire second floor but 50% of the building must remain retail. This could really help the downtown area. Multi family is allowed in NMU which will now be a conditional use. Brenda Thompson made motion to approve the text amendments as written with the exception of multi-family being changed from a permitted use to a conditional use in NMU, CH, C1 and C2. Tony Sells seconded, all voted in favor and motion carried.

REMOVE TEMPORARY MORATORIAUM

Tony Sells made motion to remove the temporary moratorium on accessory, loft and efficiency dwellings in all zoning districts. Brenda Thompson seconded, all voted in favor and motion carried.

APPROVAL OF QUOTE TO INSTALL INSULATION

Bruce Altznauer stated that the quotes for the insulation need to be tabled. He stated we have three different quotes but two are for R-30 blown and the other is for profill open cell foam. We need to call Ace and Medford and get a quote for the same spray foam and to not include the shop. No vote was taken.

OLD / UNFINISHED BUSINESS

Morgan County Planner Tara Cooner stated that we are officially a qualified local government. She stated the comprehensive plan is officially done and then gave the council a hard copy of the Comprehensive Plan and a thumb drive with a copy.

Debbie Kilgore advised that speed humps would be re-painted soon.

EXECUTIVE SESSION

Brenda Thompson made motion to exit the regular meeting to enter executive session to discuss a personnel matter. Tim Smith seconded, all voted in favor and motion carried. Brenda Thompson made motion to exit executive session and enter regular session. Tim Smith seconded, all voted in favor and motion carried. Council agreed on a 3% rate increase for all employees to become effective on the next payroll. Tim Smith made motion to adjourn. Brenda Thompson seconded, all voted in favor and motion carried.
