CALL TO ORDER

Mayor Pro Tem Brenda Thompson called to order the regular meeting of the Rutledge City Council. Council members Chad Cook, Tim Smith and Bruce Altznauer were present as were members of the public.

PLEDGE OF ALLEGIENCE

The council and citizens stood and said the Pledge of Allegiance.

APPROVAL OF MINUTES

Chad Cook made motion to approve the minutes of the June 15, 2015 meeting minutes as submitted. Tim Smith seconded, all voted in favor and motion carried.

BUSINESS LICENSE APPROVAL – MADISON MEDICAL ASSOCIATES

Brenda Thompson stated a business license application had been submitted by Dr. David Fletcher for a medical practice at 113 Fairplay Street in Dr. Hughes building. She said it is allowed. Chad Cook made motion to approve the business license. Tim Smith seconded, all voted in favor and motion carried.

FRED FRANKLIN – ALLEY NEXT TO WAREHOUSE

Fred Franklin addressed the council and said he talked to them about four months ago. I have got the survey and it looks like it is owned by the city. I have spoken with Chuck Jarrell and he suggested that I ask the city if they would abandon it if it is not being used. I would use the back of it for a garden and would be willing to let the city use the front for parking. Bruce Altznauer said you would trade some parking for the city abandoning the alley. Fred Franklin said he would block it off and it would become his driveway and he would give up the legal right of way in the front for parking. Tim Smith stated that the City would need to talk to Chuck and the city attorney.

VARIANCE REQUEST – HASSAN ALI LNU – TARA COONER

County planner Tara Cooner addressed the council and stated the owner of the Park and Shop on Hwy 278 requested a variance for the side setbacks between the Park and Shop and the old arcade building. Side setbacks are 15 feet. They have 17 feet and are proposing to reduce it to 15 feet on one and 2 feet on the other building. The staff s review does not meet the criteria. Chuck Jarrell has concerns on the condition of the buildings. The Planning Commission recommended denial. Tara Cooner stated are you prepared to set a precedent to allow a 2 foot side setback. She said your ordinance does not allow a zero lot line. Sonny addressed the council and said he can move the building. He could modify it by extending it on one side and reducing it on the other. Tara Cooner stated that her concern was the expense to move the wall. Sonny stated the main reason was the rent went up and he wants to buy and pay mortgage. He said if I buy it I am going to make it bigger and better looking and he will also renovate. Tara said if you give permission you could grandfather in the front set back of 39 feet. Chad Cook stated we want you to stay. He said we can grandfather in the front setback. Mayor pro tem Brenda Thompson asked for public comment for or against variance. There was none. Chad Cook made motion to deny the variance, but allow existing front set back of 39 feet on any new construction. Tim Smith seconded, all voted in favor and motion carried.

ETHICS FILING PORTAL

Debbie Kilgore advised that Bobby Howington had sent this information about filing your reports to the state and it is information only.

SPEED HUMP FOLLOW UP AND SIGN INFORMATION

Brenda Thompson stated that in order to put any speed humps down the traffic engineer would have to do a study. The cost would be $200.00 per hour. She stated the cost of the radar sign would be $3600.00.

SPECIAL EVENT APPLICATION

Debbie Kilgore advised the council that the ordinance that was written for special events requires an application. She stated that it has raised many questions since Ouida Autry had been working on it. One question is will the BBQ shed use be considered a special event. She asked the council to look over the application and give some feedback as to what we should classify as a special event.

E.R. UTILITY SOLUTIONS – REPAIR WEST MAIN

Brenda Thompson stated that the repairs on West Main will require someone that can do manhole repair and road repairs. Ricky Blevins does all the city’s work and submitted a quote of $23,200.00 which includes fixing four manholes and the sinking line. Guy Kemp recommended we use Ricky Blevins. Tim Smith made motion to accept bid of $23,200.00 from E.R. Utility Solutions. Bruce Altznauer seconded, all voted in favor and motion carried.

UPDATE ON FEARS ROAD WELL

Debbie Kilgore advised the council that she had spoken with Weyerhaeuser and they have authorized attorney Charles Merritt to get the deed for the well property changed over to the City of Rutledge.

Chad Cook made motion to adjourn. Bruce Altznauer seconded, all voted in favor and motion carried.
